Do You Have a Lemon?

Six Signs Your Car
Qualifies Under NY Law

You don't need all six. Any one of these may be enough to qualify. Call us for a free evaluation.

01

Same Repair 4+ Times

The same defect has been brought in for repair 4 or more times within the first 2 years or 18,000 miles — and it still isn't fixed.

02

30+ Days Out of Service

Your vehicle has been in the shop for a cumulative 30 or more days due to repairs — including time waiting for parts to arrive.

03

Safety Defect — 2 Attempts

A defect that could cause death or serious injury has been attempted to be repaired 2 or more times without success. Lower threshold for safety issues.

04

Problem First Reported in Warranty Period

The problem was first reported within 2 years from delivery or 18,000 miles — whichever comes first. This is when coverage is established.

05

Used Car From a Dealer

Under the NY Used Car Lemon Law, cars from dealers with written warranties qualify if 3 repair attempts fail for same issue, or 15+ days out of service.

06

Extended Warranty Failures

Even past the initial lemon law period, repeated failures under an extended manufacturer's warranty may qualify under Magnuson-Moss.

What You're Entitled To

Everything the Law
Says You're Owed

💵

Full Purchase Refund

Every dollar you paid — purchase price, sales tax, registration fees, and financing charges already made. Complete refund.

🚙

Replacement Vehicle

A comparable new vehicle of the same or similar make and model, at no additional cost. Refund or replacement — your choice.

💰

Cash Settlement

In many cases, the manufacturer pays you cash to keep the vehicle — settlement amounts of $7,500 to $20,000+ depending on the defect.

The Manufacturer Pays Your Attorney Fees

Under NY General Business Law § 198-a and the Magnuson-Moss Warranty Act, if you prevail, the manufacturer must pay all attorney fees and legal costs separately from your compensation. You receive your full refund or cash settlement plus the manufacturer writes a separate check for our legal fees. You keep every dollar of your award.

FAQ

Lemon Law Questions
Answered Straight

Does lemon law cover used cars?
+

Yes — New York's Used Car Lemon Law covers cars purchased from a dealer (not private sale). The dealer must provide a written warranty. If they can't fix the same problem after 3 attempts, or if the car is out of service 15 cumulative days, you're entitled to a full refund.

My car is over 18,000 miles. Am I out of luck?
+

Not necessarily. The Magnuson-Moss Warranty Act (federal lemon law) applies to any vehicle with a written warranty — including extended warranties — regardless of mileage. If the manufacturer can't repair your vehicle within a reasonable number of attempts, you may still have a claim.

Can I keep my car and still get money?
+

Yes. In many cases we negotiate a cash settlement — you keep the vehicle and receive a cash payment. Some clients have received $8,000 to $20,000 while keeping their car. The right strategy depends on your situation, which we evaluate for free.

How does arbitration work?
+

The NY Attorney General's office runs a lemon law arbitration program. We submit your case, the manufacturer responds, an arbitrator issues a binding decision. Most cases resolve through direct negotiation before arbitration — typically within 3 to 6 months.

Does lemon law cover leased vehicles?
+

Yes — both purchased and leased vehicles are covered. For leased vehicles, the remedy may be a lease termination and refund of payments made, or a replacement vehicle. We'll identify the right remedy for your situation.

What documents do I need?
+

The most important are your repair invoices. Every time your car went in, you should have received a written repair order. Keep every one. If you've lost some, dealers are required to maintain records and we can subpoena them.
